Welcome to Venus! Please read these Terms of Use (“Terms”) carefully before using any part of our mobile application, website, or related services (collectively, the “Service”).

These Terms form a legally binding agreement between you and Venus Labs Inc. (“Venus,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

The Service is intended for individuals thirteen (13) years of age or older. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

2. Medical Disclaimer

Venus provides AI‑powered skincare information for general wellness and educational purposes. We do not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any medical or dermatological concerns.

3. Account and Security

To access certain features, you may need to create a user account.
You are solely responsible for safeguarding your login credentials and for all activity under your account. You may not share your credentials, impersonate others, or access another user’s account. Notify us promptly at admin@venus‑labs.io if you suspect unauthorized use or a security breach.

4. Acceptable Use Policy

You agree to use the Service only for lawful, personal, non‑commercial purposes.
You may not:

• Use the Service in violation of any law or regulation.

• Reverse‑engineer, decompile, or modify any portion of the Service.

• Upload or transmit viruses, malware, or harmful code.

• Attempt to gain unauthorized access to our systems or data.

• Use automated scripts, bots, or scrapers to collect information.

• Post abusive, defamatory, or infringing content.

Violations may result in immediate suspension or termination of your account.

5. User Content

You retain ownership of the photographs, images, and data you upload (“User Content”).
By submitting User Content, you grant Venus a non‑exclusive, worldwide, royalty‑free license to use, store, and process that content only as necessary to provide and improve the Service, consistent with our Privacy Policy.
We do not use your content for advertising or facial‑recognition purposes.

6. AI‑Powered Features

Venus uses artificial intelligence to analyze facial images and generate skincare insights.
AI outputs are predictive and may not always be accurate. You understand these results are informational only and not a substitute for professional medical evaluation.
Some AI features may rely on third‑party providers processing de‑identified data to generate responses.

7. Subscriptions and Billing

Apple App Store Users

• Subscriptions are managed through your Apple ID and renew automatically unless canceled.

• Charges occur through your iTunes / Apple account before each billing period.

• Manage or cancel anytime in Settings › Apple ID › Subscriptions.

• For billing or refund questions, contact Apple Support directly.

Google Play Users

• Subscriptions are linked to your Google Account and renew automatically unless canceled.

• Manage or cancel anytime in Google Play › Menu › Subscriptions.

• For billing questions, contact Google Play Support directly.

  
  

No Refund Policy

All subscription payments are final and non‑refundable, including renewals, unless a refund is required under applicable law or platform (Apple / Google) policy.
Deleting or uninstalling the app does not cancel your subscription.

By subscribing, you authorize the relevant app store to manage payment processing on our behalf and agree to its applicable terms.

8. Intellectual Property

All content, trademarks, logos, visual design, text, graphics, and software within the Service—including AI‑generated outputs—are the intellectual property of Venus or its licensors and protected under applicable copyright and trademark laws.
You may not copy, distribute, or reproduce any portion of the Service without prior written consent.

9. Feedback

By submitting suggestions, ideas, or feedback, you grant Venus a perpetual, royalty‑free license to use them without obligation or compensation.

10. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for violations of these Terms, suspected fraud, or other actions harmful to our users or platform.
Upon termination, your access ends immediately. We may retain minimal transactional or audit data if required by law or for fraud‑prevention.

11. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available.”
Venus Labs Inc. disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.

To the fullest extent allowed by law:

• Venus Labs Inc. and its affiliates are not liable for any indirect, incidental, or consequential damages (including loss of data, profits, or goodwill).

• Our total cumulative liability for any claim shall not exceed the amount you paid to Venus in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions may not allow such exclusions; in those cases, liability will be limited to the extent permitted by law.

12. Changes to These Terms

We may update these Terms at any time. Material changes will be posted in‑app and become effective upon publication. Continued use of the Service signifies acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict‑of‑law principles.

Any dispute, claim, or controversy arising out of or relating to the Service shall be resolved by binding arbitration on an individual basis in California under the rules of the American Arbitration Association.
You and Venus waive the right to a jury trial or to participate in any class or representative action.
You may alternatively pursue a qualifying claim in small‑claims court.
